GoVelora™ Marketplace Legal & Policy Framework

Welcome to GoVelora™, a digital and physical goods marketplace platform. By using GoVelora™, whether as a vendor or customer, you acknowledge and agree that GoVelora.com™ functions solely as a neutral intermediary providing marketplace infrastructure.

Vendors are independent businesses. GoVelora.com™ does not create, store, ship, inspect, or warrant any product or service offered by vendors. All liabilities, warranties, obligations, and compliance responsibilities rest exclusively with vendors.

This framework sets forth mandatory vendor requirements, customer rights, and legal protections for GoVelora.com™.

1. Shipping & Fulfillment

• Vendors must provide clear shipping policies, including processing times, carriers, delivery estimates, and fees.

• Risk of loss transfers to the customer upon vendor shipment unless otherwise required by law.

• Vendors bear full responsibility for compliance with international trade, customs, tax, and import/export laws.

2. Returns, Refunds & Exchanges

• Vendors must clearly disclose return windows, conditions, and exceptions (e.g., perishables, digital goods, custom products).

• All refunds, replacements, or exchanges are vendor obligations.

• GoVelora.com™ is not liable for vendor non-performance, misrepresentation, or customer dissatisfaction.

3. Payments & Financial Terms

• GoVelora.com™ provides access to secure third-party payment processors.

• GoVelora.com™ does not store payment credentials and assumes no liability for disputes, chargebacks, fraud, or reversals.

• Vendors must not bypass the platform’s payment system; circumvention may result in termination.

4. Cancellations & Order Modifications

• Vendors may define cancellation windows (e.g., within 24 hours).

• Non-cancellable categories (custom, already-in-production) must be disclosed.

• Refund obligations for cancellations rest solely with vendors.

5. Privacy & Data Protection

• GoVelora.com™ complies with applicable data protection laws (e.g., GDPR, CCPA) at the platform level.

• Vendors act as independent data controllers for personal data obtained via transactions and are fully responsible for misuse, breaches, or violations.

• GoVelora.com™ may process limited data for fraud prevention, compliance, and dispute resolution.

6. Customer Service & Disputes

• Vendors must maintain valid and responsive communication channels.

• Customers must first seek resolution directly with vendors.

• GoVelora.com™ may, at its discretion, act as a neutral mediator but assumes no responsibility for outcomes.

7. Marketplace Conduct

• Vendors and customers must act in good faith and refrain from fraud, abuse, or prohibited activities.

• GoVelora.com™ may suspend, restrict, or terminate access at its discretion in response to violations.

8. Digital & Custom Products

• Vendors must disclose delivery mechanisms for digital products (download links, emails, or platform delivery).

• Vendors must define usage rights (e.g., personal, non-transferable).

• Digital and custom products are generally non-refundable and non-returnable except as required by law.

9. Legal & Regulatory Compliance

• Vendors are solely responsible for compliance with consumer protection, e-commerce, tax, trade, advertising, and intellectual property laws in all jurisdictions where they operate.

• GoVelora.com™ reserves the right to remove listings or suspend vendors for suspected unlawful or non-compliant conduct.

10. Indemnification & Limitation of Liability

• Vendors shall indemnify, defend, and hold harmless GoVelora.com™, its officers, affiliates, and employees from any claims, damages, liabilities, or costs arising out of:

  • defective or unsafe products

  • misrepresentation, fraud, or false advertising

  • legal or regulatory violations

  • intellectual property infringement

  • disputes with customers

• GoVelora.com™ disclaims all express and implied warranties, including merchantability and fitness for purpose.

• GoVelora.com™’s total liability, under any legal theory, shall not exceed the lesser of:

  • $100 USD, or

  • The total platform fees collected by GoVelora.com™ from the vendor in the 30 days preceding the claim.

11. Governing Law & Dispute Resolution

• This Agreement is governed by the laws of [Insert Jurisdiction – e.g., Delaware, USA], excluding conflict-of-law principles.

• All disputes shall be resolved through binding arbitration under [Arbitration Association Rules], unless otherwise required by applicable law.

• Vendors and customers expressly waive any right to class actions or collective proceedings against GoVelora.com™.

• GoVelora.com™ may amend or update these policies at any time. Updates take effect upon posting.

• Continued use of the platform constitutes acceptance of updated terms.

• GoVelora.com™ disclaims responsibility for product quality, safety, legality, or accuracy of vendor listings.

• Buyers acknowledge inherent risks in online commerce and agree that disputes must be pursued primarily against vendors.
